This Policy forms an integral part of the Company’s Terms & Conditions, Privacy Policy, Cancellation Policy, Refund Policy, and other applicable policies, and shall be read in conjunction with the same.
1. NATURE OF DELIVERY
Giftport deals exclusively in digital products, including digital gift cards, vouchers, reward instruments, and related services. As the products offered on the Platform are intangible in nature, no physical shipping is involved.
Delivery of digital products is carried out electronically through methods such as email, SMS, user dashboard access, API-based delivery, or other electronic communication channels as determined by the Company.
2. DELIVERY TIMELINES
Digital products are generally delivered instantly or within a reasonable time after successful completion of payment and order confirmation. Delivery timelines may vary depending on factors such as product availability, third-party issuer response, payment verification, regulatory checks, or technical constraints.
The Company does not guarantee any specific delivery time and shall not be liable for delays arising due to circumstances beyond its reasonable control, including delays attributable to payment gateways, banking systems, telecom operators, or third-party brand partners.
3. DELIVERY CONFIRMATION
Delivery shall be deemed complete once the digital gift card, voucher, or reward instrument has been successfully generated and transmitted to the User or the designated recipient through the registered communication channel or made available on the Platform.
The User is responsible for ensuring that the contact details provided at the time of placing the order are accurate and accessible. The Company shall not be responsible for non-delivery resulting from incorrect or incomplete information provided by the User.
4. FAILED OR PARTIAL DELIVERY
In the event of a failure or partial delivery caused due to a technical issue attributable to the Company or its authorized service providers, the Company shall undertake reasonable efforts to reprocess the delivery or provide an appropriate resolution in accordance with its Refund Policy.
No liability shall arise where delivery failure occurs due to reasons beyond the Company’s control or due to errors attributable to the User.
5. DELIVERY THROUGH API AND BULK ORDERS
For API-based integrations, bulk orders, or enterprise reward programs, delivery shall be governed by the technical and contractual arrangements agreed between the Company and the business client. Once delivery processing has commenced through such mechanisms, the transaction shall be deemed final.
6. GEOGRAPHICAL LIMITATION
Digital products offered by Giftport are intended for use and redemption within India, unless expressly specified otherwise. The Company does not guarantee acceptance or redemption of gift cards or vouchers outside India.
7. TRANSFER OF RISK AND OWNERSHIP
Risk and ownership in the digital product shall transfer to the User upon successful electronic delivery of the product. Thereafter, the Company shall not be responsible for any loss, misuse, unauthorized access, or redemption of the digital product.
8. LIMITATION OF LIABILITY
To the maximum extent permitted under applicable law, the Company shall not be liable for any indirect, incidental, or consequential losses arising from delays, failures, or issues related to delivery of digital products.
9. MODIFICATION OF POLICY
The Company reserves the right to amend, modify, or update this Policy at any time to reflect changes in business practices, legal requirements, or regulatory expectations. Any such changes shall be effective upon publication on the Platform.
10. GOVERNING LAW AND JURISDICTION
This Policy shall be governed by and construed in accordance with the laws of India. Courts having competent jurisdiction in India shall have exclusive jurisdiction over all matters arising out of or relating to this Policy.
